MOOT COURT

 

WISPCON IV, like all the other WISPCONs before it, WISPCON IV  brings you the hottest topics and training for License Exempt WISPs. In keeping with this tradition and the apparent need for resolution of an issue that effects all License Exempt users, manufacturers, resellers, consultants, investors and even has the interest of the FCC, WISPCON IV will be holding a Moot Court to decide on Interference issues.

          

The PART-15.ORG Moot Court Competition


Scope: License Exempt Wireless Internet Service Providers Organization moot 

court competition sponsored by PART-15.ORG.  The contest challenges opposing 

parties to research and identify a compelling legal issue confronting the License 

Exempt Wireless Internet Service Providers industry and propose a resolution. A national panel of legal experts will judge the moot court and render a ruling.

Eligibility: Open to all accredited Law School graduates and students

 

Prizes: First Place -- $3,000 team; Second Place team -- $2,000; Best student paper and research - $1,000

 

Rules Summary: 3 member teams, 1 team per opposing party; Briefs no longer than 30 pages; Oral arguments no longer than 30 minutes

 

Critical Dates: Entry (no later than) August 15, 2003; Briefs Due Sep 1, 2003; Arguments October 10, 2003; Trial Oct 26, 2003 (Dallas)

 

 

Issues: There are three issues (1) Does any one person have the right to prevent  the use of (FCC) Part 15 devices of another? (2) Is there a civil recourse in lieu of the lack of federal intervention? (3) Are the two claims in this case, the appropriate civil recourse in dealing with interference issues caused by (FCC) Part 15 radio devices.
